TERMS & CONDITIONS OF SALE
The conditions stated herein make up the terms and conditions in which we offer items for sale. While bidding at auction, it is understood that the buyer has agreed to be bound by these terms governing our sales.
No premium is added to the hammer price of each lot in our online only auction. Successful bidders are under obligations to make payment within five (5) days of point of sale, unless previous arrangements have been made with the auction house ahead of time. Bidders who are successful will be notified electronically within 36 hours of date of auction. Payments accepted are Visa/Master Card, Paypal, Transfers. The auction house reserves the right to hold or not to release to the successful bidder by the auction house unless all outstanding payments are settled. The successful bidder who is the purchaser is legally responsible for the payment of the property. Defaulting to complete payment within the time specified may result in legal proceedings and most certainly will result in non-issuance of a bidding number in the future. If a response to our original email has not been received within 3 days, a Non-Paying Bidder (NPB) warning will be placed until payment has been made. All auction sales & bidding are recorded.
During the biddings, all items are sold to the highest bidder as recognized by the auctioneer. The auctioneer has the right to reject any bid; to advance the bidding at his discretion; and, in the event of a dispute between two bidders, determine the successful bidder or to reoffer and resell the lot in dispute. Should there be any dispute after sale, the record of final sale shall be conclusive. Some items offered may be subject to reserve, which is the confidential minimum price below which such lot will not be sold. We may implement such reserves by bidding on behalf of the Consignor.
Purchasers should always examine the physical conditions of lots in all cases. It is the responsibility of prospective buyers to scrutinize lots and develop interest in a given lot to make up their minds for bidding. For the accuracy of any printed or verbal descriptions, neither the auctioneer, nor the consignor/artist, is responsible. All weights and measurements are mere approximations. Please contact the auction house for condition reports if there is any question.
The auctioneer has the right to remove any lot before or at the sale and shall have no liability whatsoever for removal of property.
Packaging and handling of purchased lots is at the risk and expense of the buyer. As a service to the purchaser, Mbonu-Emerem Auctions House can arrange for packing, shipping and insurance, unless otherwise noted in the lot description. All expenses incurred must be paid for by the purchaser. We will not be held responsible for choosing a shipper in the event of any act and/or omissions in packing. We do not assume responsibility for damages. Regardless of shipping method, auction house must have received all the outstanding payments to release property. Shipping may take up to four weeks after payment is received.
Returns will be accepted if it is determined that the auctioneers have erred in their catalogue description. However, if the auctioneer should make verbal or online additions, corrections or modifications to the catalogue at the point of sale, this disclosure formally amends the original printed or online catalogue description. Returns must be accompanied by a written statement from a mutually agreed upon arm?s length third party confirming the discrepancy. Arrangements for returns must be made with the auctioneers within fourteen (14) days of purchase. Under no circumstance will this time period be extended unless arrangements have been made within the two (2) week period. Auctioneers do not guarantee any verbal accounts of integrity or condition offered for telephone/absentee clients.
You have the right to cancel the contract for the purchase of a lot within 14 calendar days. The cancellation period will expire after 14 calendar days from the day on which you acquired (or a party nominated by you and is not the shipper) physical possession of the lot.
To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear written statement (e.g. a letter sent by post, email), or by contacting a member of staff. The communication must be received within 14 calendars days from the day on which you acquire the lot.
If you cancel the contract, we will reimburse all payments received from you. As Mbonu-Emerem Auctions House is unable to provide a postage or packing service, the cost of the initial delivery or collection is not returnable. In addition, the cost of returning the item, if you choose to cancel the contract is payable by you.
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of damaged caused by unnecessary handling whilst in your possession. We will make the reimbursement without undue delay, and not later than 14 calendar days after the day we receive back from you any goods supplied, or (if earlier) 14 calendar days after the day you provide evidence that you have returned the goods.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
Neither Mbonu-Emerem Auctions House nor the seller will be responsible to you for errors during or after the online only timed auction or failures to execute bids placed on the internet or on your mobile device, including, without limitation, errors or failures caused by: any loss of connection to the auction being conducted online; a failure or difficulties with the online bidding software or the website service provider; and/or a breakdown or problems with any internet connection, computer, mobile device or system.
You are responsible for any value added tax (VAT) (including but not limited to, any Import VAT), sales tax or value added sales tax, sales or compensating use tax or any other similar tax payable as a result of the sale of the lot. Tax charges and refunds depend on the particular circumstances of the buyer so the information in the Sale Particulars, which is not exhaustive, should be used only as a general guide. In all circumstances the applicable law of the relevant jurisdiction takes precedence.
